Not Guilty 5-JCF-3C-09 (Ref 4-JCF-3C-13)
If a juvenile is found not guilty of an alleged rule violation, the disciplinary report is removed from all of the juvenile’s files. Comment : When a juvenile is found guilty of only some of the rule violations with which he or she was originally charged in connection with a single incident, and when that incident is described in a single disciplinary report, the juvenile’s record should clearly show the violations that were not proved. All disciplinary reports, regardless of disposition, may be kept and used for statistical or research pur poses providing all identification is removed. Where there are multiple incidents, alleged rule violations for which a juvenile is found not guilty must be separated and removed from the juvenile’s file. When multiple incidents/charges are listed in a single report, charges resulting in not-guilty findings may be marked over or blacked out. Protocols : Written policy and procedure; hearing record forms; disciplinary report forms; juvenile handbook; rules.
