Established process allows juveniles to request any staff member to repre sent them at disciplinary hearings and to question relevant witnesses Staff representatives are appointed when it is apparent a juvenile is not capable of effectively collecting and presenting evidence on their own behalf

Committee’s Decision 5-JCF-3C-07 (Ref 4-JCF-3C-11)

The disciplinary committee’s decision is based solely on information obtained in the hearing process, including staff reports, the statements of the juvenile charged, and evidence derived from witnesses and documents Comment : Both the juvenile’s representative and committee members may ques tion witnesses requested by the juvenile. Witnesses who cannot respond to ques tions in person can be asked to submit written statements. The juvenile should be permitted to obtain and submit any relevant documents. A written record is made of the decision and the supporting reasons and a copy is given to the juvenile The hearing record and the supporting docu ments are kept in the juvenile’s file and in the disciplinary committee’s re cords Comment : The disciplinary-hearing record should include the decision, the dis position, and the reason for the action, unless doing so would jeopardize facility security.
