3. Justice and Order

GOAL: Juveniles’ rights are not violated. 3A. - PERFORMANCE-BASED STANDARD: ACCOUNTABILITY Maintain an orderly environment with clear expectations of behavior and systems of accountability that treat juveniles fairly and respect their legal rights. Provide services that hold juveniles accountable for their actions and encour age them to make restitution to their victims and their communities. EXPECTED PRACTICES Access to Counsel and Courts 5-JCF-3A-01 (Ref 4-JCF-3A-01) Juveniles have access to counsel, confidential contact with attorneys, their au thorized representatives, the courts, and to legal material Contact includes, but is not limited to, telephone communications, uncensored correspondence, and visits

Comment : Facility authorities should assist juveniles in making confidential con tact with attorneys and their authorized representatives, who may include law stu dents, special investigators, lay counsel, or other persons who have a legitimate connection with the legal issue being pursued. Provisions should be made for visits during normal facility hours, uncensored correspondence, telephone communica tions, and after-hours visits requested because of special circumstances. The right of access to the courts minimally provides that juveniles have the right to present any issue, including the following: challenging the legality of their convic tion or confinement; seeking redress for illegal conditions or treatment while under correctional control; pursuing remedies in connection with civil legal problems; and asserting against correctional or other government authority any other rights protected by constitutional or statutory provision or common law. Juveniles seek ing judicial relief are not subjected to reprisals or penalties because of the decision to seek such relief.
