Prevailing Rate 5-JCF-6H-03 (Ref 4-JCF-5H-03)
Juveniles employed in the community by public or private organizations in positions normally occupied by private citizens are compensated at the pre- vailing rate Comment : Compensation for all work performed for public or private organiza tions, whether for work-release programs or as part of an outside work assignment plan, should be at the prevailing rate and should include all fringe benefits. Protocols : Work-release program descriptions; screening/application tools used for selecting juveniles for programs; agreements with public and private organiza tions regarding wages and benefits. Process Indicators : Lists of clients involved in work-release programs; records review to include wage and benefit statements; interviews with juveniles, staff, and community work providers. Juveniles are not permitted to perform any work prohibited by state and fed eral regulations and statutes pertaining to child labor Comment : Juveniles in correctional facilities should not be permitted to perform work that juveniles in the community would be prohibited from performing pursu ant to state and federal child labor laws. Protocols : Applicable jurisdictional child labor laws; juvenile work/employment plan. Process Indicators : Specific identification of allowable jobs for juveniles based on specific ages; verification of documentation that jobs are reviewed against appli cable labor laws.
