C-3H Constitutional Minimums for Behavioral Health Services in Correctional Facilities ( Y CE, CE) Track: Mental Health Room 204-A

People held in custody within a correctional setting have a basic right to mental health care and humane conditions of confinement protected by the Eighth Amendment prohibition of cruel and unusual punishment. Although these Eighth Amendment rights do not require the highest quality of health care, the care and conditions of confinement must reflect basic common decency and dignity. Furthermore, the Fourteenth Amendment “due process” clause establishes procedural requirements that protect the “liberty interests” of people who are incarcerated. This training will explore constitutional case law applied to behavioral health treatment and systems of care within correctional facilities and systems.
