Probationary Term 5-ACI-1C-12 (Ref. 4-4059)

Written policy, procedure, and practice provide that employees covered by merit systems, civil service regulations, or union contract are appointed ini- tially for a probationary term of at least six months but no longer than one year unless national or state regulations specify otherwise. Comment : Employee performance during the probationary term should be eval- uated at least every two months using forms developed for that purpose, and all employees should have the opportunity to discuss their evaluations. Those not per- forming satisfactorily should be terminated during their probationary period. Em- ployees transferring from one facility to another within the same system should not be required to repeat a probationary term.

Provisional Appointments 5-ACI-1C-13 (Ref. 4-4060)

Written policy, procedure, and practice provide for provisional appointments to ensure that short-term personnel, both full-time and part-time, can be available during emergencies. Comment : Civil service, merit system, and union requirements should be modified to allow the short-term employment of additional personnel during vacations, rises in the inmate population, or other situations that leave the institution understaffed. While provisional personnel should meet the minimum requirements for the posi- tions they fill, they should not be considered permanent replacements for perma- nent personnel.
