Written policy, procedure, and practice provide that the disciplinary commit- tee’s decision is based solely on information obtained in the hearing process, including staff reports, the statements of the inmate charged, and evidence derived from witnesses and documents. Comment : Witnesses requested by the inmate may be questioned by both the in- mate’s representative and committee members. Witnesses who cannot respond to questions in person can be asked to submit written statements. The inmate should be permitted to obtain and submit any relevant documents.

Hearing Record

Written policy, procedure, and practice provide that a written record is made of the decision and the supporting reasons, and that a copy is given to the in- mate. The hearing record and supporting documents are kept in the inmate’s file and in the disciplinary committee’s records. Comment : The disciplinary hearing record should include the decision, the dispo- sition, and the reason for the action, unless doing so would jeopardize institutional security.
