Case Details

Outcome

– P.G. filed a civil rights action against Jefferson County Jail (sheriff, undersheriff, and jail admin istrator) because P.G. was faced with imminent incarceration at the county jail in New York. – During a 42-day sentence, P.G. suffered severe withdrawal, including pain, nausea/vomiting, diar rhea, anxiety, and sleeplessness.

– P.G. alleged that the jail refuses to provide methadone treatment to non-pregnant individuals who are incar cerated at the jail, which violates: • the Americans with Disabilities Act (ADA) • the Fourteenth Amendment • related state law – The jail rebutted the claimed violation of the Fourteenth Amendment, stating: • “there is no constitutional right to methadone treatment” • “other medications can manage P.G.’s symptoms” – The court ordered that the preliminary injunction be granted, and that P.G. receive daily methadone during the period of incarceration at the Jefferson County Jail.
