Emerging Legal Trends in Corrections

It is difficult to imagine an era in the history of corrections when courts have more frequently and rou- tinely addressed issues impacting today’s correctional environments. From issues surrounding restric- tive housing to new emerging standards related to the incarceration of transgender individuals, our courts have become the primary arena for direct challenges to important correctional policies and procedures. If anything, the COVID-19 pandemic further increased the attention devoted by our court systems to the on-going operations of correctional facilities across our nation. In this session, we will highlight the fast-emerging legal trends that will impact the obligations and decisions of correctional professionals, how we operate our correctional facilities and how we educate, protect and care for our incarcerated populations.

1. Familiarize corrections employees with current legal issues facing jails, commu- nity corrections and prisons. 2. Review professional operations that ad- here to legal standards and requirements. 3. Educate corrections management in ensuring staff performance is consistent with current judicial decisions. 4. Explore the future direction of legal rulings for best practices in the profession.
